Terms of Service

Last updated: 16 April 2026

These terms govern your use of passcast.tv and all services provided by ArdSeek Media Ltd (“PassCast”, “we”, “us”, “our”), a company registered in Ireland.

By accessing or using PassCast as a viewer, broadcaster, or visitor, you agree to be bound by these terms. If you do not agree, please do not use the service.

1. What PassCast Does

PassCast is a pay-per-view live streaming platform. It enables broadcasters, sports organisations, clubs and event organisers to stream live and on-demand content to paying viewers.

PassCast offers several service tiers. Community events are covered by the Community Event Organiser Terms of Service. White-label Channel and Enterprise services are covered by individual service agreements signed at the point of sale.

2. Accounts

Some features of PassCast require you to create an account. You are responsible for keeping your account credentials secure. You must notify us promptly at kevin@passcast.tv if you suspect your account has been accessed without your permission.

You must provide accurate information when creating an account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create a broadcaster account.

3. Viewers and Ticket Purchases

When you purchase a ticket through PassCast, you are purchasing access to a specific live stream or on-demand recording for the duration stated on the event page. Live tickets grant access only to the live broadcast. On-demand tickets grant access to the recorded replay for the period specified by the event organiser.

Access is personal to the purchaser. You may not share your access with others, sell or transfer your ticket, or record and redistribute the stream.

Ticket prices are set by the organiser of each event. All prices include any applicable processing fees.

4. Refunds

Refunds may be issued at our discretion where a technical failure on the PassCast platform prevented you from accessing content you paid for. Refund requests should be sent to kevin@passcast.tv and must be made within 30 days of the event.

Refunds for reasons outside our control (including event cancellation by the organiser, poor content quality, viewer error, or change of mind) are handled by the event organiser, not PassCast.

5. Broadcaster Responsibilities

Broadcasters using PassCast are responsible for the content they stream. This includes holding all necessary rights, licences and permissions to broadcast that content, and for complying with all applicable laws.

Broadcasters must not stream content that is illegal, defamatory, obscene, hateful, or that infringes the rights of any third party. Specific obligations are set out in the Community Event Organiser Terms or your individual service agreement.

6. Acceptable Use

You may not use PassCast to:

Attempt to gain unauthorised access to other users' accounts, our systems, or any part of the platform not intended for you.

Record, capture, re-broadcast or redistribute content from a PassCast stream without the express written permission of the broadcaster and PassCast.

Interfere with or disrupt the platform, including by introducing malicious code, attempting denial-of-service attacks, or probing for vulnerabilities without permission.

Use the platform in a way that violates any applicable law, or that infringes the rights of others.

7. Content Moderation

PassCast reserves the right to suspend or terminate any stream or account if we reasonably believe the content violates these terms, infringes third-party rights, or poses a legal risk to PassCast or its users.

We will respond to valid takedown requests in accordance with applicable law, including DMCA notices or equivalent local provisions.

8. Intellectual Property

The PassCast platform, including all software, branding, logos, and design, is owned by ArdSeek Media Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose.

Broadcasters retain all rights to the content they stream. By streaming content on PassCast, broadcasters grant PassCast a non-exclusive licence to transmit, store, and display that content as necessary to provide the service.

9. Third-Party Services

PassCast uses third-party services including Stripe for payments, Mux for video infrastructure, Supabase for data storage, Vercel for hosting, and Resend for email delivery. Your use of PassCast may be subject to those providers' own terms. We are not responsible for the acts or omissions of third-party providers.

10. Service Availability

PassCast provides the platform on an “as is” basis. While we make reasonable efforts to ensure availability and reliability, we do not guarantee uninterrupted service. Technical issues may occur, including stream outages, encoding failures, and payment processing delays.

We may, at our discretion, perform scheduled maintenance that temporarily interrupts the service. We will use reasonable efforts to provide advance notice of planned maintenance.

11. Limitation of Liability

To the fullest extent permitted by law, PassCast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, or loss of data, arising from your use of the platform.

PassCast's total liability in connection with these terms or your use of the platform shall not exceed the greater of: (a) the total amount you have paid to PassCast in the 12 months preceding the claim, or (b) £100.

12. Indemnification

You agree to indemnify and hold harmless ArdSeek Media Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your content, your breach of these terms, or your violation of any third-party rights.

13. Privacy

Our handling of personal data is described in our Privacy Policy. By using PassCast, you acknowledge that you have read and understood that policy.

14. Termination

You may stop using PassCast at any time. Broadcasters may close their account by contacting us at kevin@passcast.tv. Any outstanding contractual obligations survive termination.

We may suspend or terminate your access at any time for breach of these terms, or for any reason with reasonable notice.

15. Governing Law

These terms are governed by the laws of Ireland. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

16. Changes to These Terms

We may update these terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be notified to broadcaster account holders by email at least 14 days before they take effect. Continued use of PassCast after the effective date constitutes acceptance of the updated terms.
